Terms, Releases and Waivers

Behaviour and Safety Policy:

Inspirely Education ("Inspirely" or "we" or "our" or "us") takes pride in creating safe and enjoyable learning experiences for all participating students and staff during its workshops, programs, activities, camps, events, and field trips (the "Events"). In order to support this mission and make our events, workshops, classes, and field trips enjoyable for everyone, we have developed the following registration terms and conditions (the "Terms and Conditions").

Coarse language, yelling, bullying, non-compliance, aggressive or inappropriate behaviour, and behaviour that significantly impacts the safety or enjoyment of the staff or other participants is not permitted at any of our Events.

If any violation of the above occurs, all parents and guardians will be responsible for discussing appropriate behaviours with their children.

Behaviours that pose a safety risk to any participant or staff may result in temporary and/or immediate and permanent removal from any and all Events. No refund will be provided in such instances. No work created by participants during Events should feature violent or otherwise inappropriate themes.

Our staff will make every effort to accommodate each participant's needs and integrate them into our Events. However, we fully reserve the right to remove and withdraw your child from any Event should their behaviour cause harm to themselves, other participants, staff, or property.

Field Trip Policy, Consent and Liability Release:

Inspirely Education (Legal Name: 8074003 Canada Incorporated) periodically organizes field trips for enrolled students and their families. These field trips are designed to give children the opportunity to explore places, industries, and environments that may help shape their future career paths and spark a genuine love for learning.

For most field trips, parents and guardians are required to accompany their child to and from the field trip location. By attending, the parent or guardian assumes full responsibility for their child's supervision, transportation, and conduct throughout the duration of the field trip, including travel to and from the designated location. The responsibility of supervision remains with the accompanying parent or guardian at all times unless otherwise communicated by Inspirely in writing prior to the event.

By registering your child for any Inspirely field trip, you acknowledge and agree to the following:

Participation in field trips is entirely voluntary. Parents and guardians are responsible for arranging their own transportation to and from the field trip location. Inspirely Education, its directors, employees, contractors, interns, agents, representatives, and affiliates (collectively the "Releasees") shall not be responsible for transportation to or from any field trip location.

You, as the attending parent or guardian, accept full responsibility for your child's participation in the field trip, including travel to and from the designated location, supervision of your child during transit and throughout the event, and any activities or circumstances arising during your child's participation.

To the fullest extent permitted by law, you hereby release and forever discharge Inspirely Education (8074003 Canada Incorporated) and all Releasees from any and all claims, suits, damages, costs, and expenses of any kind arising out of or in connection with your child's participation in any field trip, including but not limited to injury, property damage, or loss, except where such claims arise solely out of the gross negligence or willful misconduct of Inspirely Education.

You acknowledge that field trips involve travel to external locations and that certain circumstances are beyond Inspirely's control. Inspirely will take all reasonable precautions to ensure a safe and enriching experience but cannot guarantee the conditions of external venues, transit routes, or other factors outside its direct supervision.

Consent to Use of Photograph, Video and Voice Recordings:

By registering for any Events, workshops, classes, or field trips, you agree to grant Inspirely Education, its affiliates, representatives, and employees the right to take photographs, videos, and voice recordings of your child during any Inspirely Event, including field trips. You hereby consent to the use of such photographs, videos, and recordings in Inspirely Education marketing and promotional materials, including but not limited to our website, social media platforms, print materials, and any other promotional channels.

You acknowledge and agree that Inspirely Education shall own all intellectual property rights, including copyright, in such photographs, videos, and recordings, and may use them with or without your child's name for any marketing or promotional activity without any compensation being payable and without any additional required consent or authorization.

This consent extends to field trip photographs and videos. Inspirely reserves the full right to use any photographs or footage captured during field trips on its website, social media, print materials, and other promotional channels.

We also obtain this consent as many enrolled children share their learnings through video and send them to us for recognition. Our primary aim in using these materials is to showcase your child's work, set them as an example, and inspire others. If you do not wish to provide this consent, please send an email to contact@inspirely.ca stating that you do not consent to the use of photographs, video, or voice recordings of your child. We will make every reasonable effort to accommodate your request, but please understand that in certain group settings this may not always be fully achievable.

Consent for Screen Sharing During Class:

In order to help your child in our online learning environment, our instructors may ask your child to share their computer screen. Screen sharing is solely for the purpose of assisting your child with educational tasks.

We strongly recommend that parents and guardians ensure no sensitive or confidential information is visible on the desktop during any online session. Inspirely will not be liable for any loss or damage in the event that confidential information is disclosed during any Event.

By agreeing to these Terms and Conditions, you provide consent for our educators and instructors to request screen sharing from your child when needed during any online Event.

Liability Waivers and Releases:

At Inspirely Education, we strive to ensure the safety and security of each participant. However, please understand that certain circumstances are beyond our control. Except for events arising solely out of the gross negligence or willful misconduct of Inspirely Education, you agree that the aggregate liability of Inspirely Education (8074003 Canada Incorporated) and all Releasees, from any and all suits, claims, damages, costs, and expenses of any kind, including injury, property damage, or death, in connection with any Events, workshops, classes, or field trips, shall be limited to the lesser of (i) $500 and (ii) the amount paid by you to Inspirely in the 6 months prior to the event giving rise to the claim.

For participation in online Events and classes, it is the full responsibility of the parent, guardian, or registering adult to provide a safe and supervised working environment for the registered child. Any liability arising out of lack of supervision shall not be the responsibility of Inspirely Education.

All disputes arising out of or in connection with any Events or classes will be interpreted and construed in accordance with the Provincial laws of Ontario and the federal laws of Canada applicable therein.

By agreeing, you certify that the information provided on your child's registration form is complete and accurate, and agree to be bound by and bind your participating child to the provisions of these Terms and Conditions.

Consent to Participate in Rewards Program:

Inspirely encourages each child to actively participate in class discussions, complete assignments and projects, collaborate with others, express creative ideas, and solve problems.

As part of Inspirely's after-school programs, each child with an active paid enrollment has an opportunity to participate in the Inspirely Bank rewards program. Each child will earn stars at the end of class which can be redeemed for various gifts. By agreeing to these Terms and Conditions, you provide consent for your child to participate in the Rewards Program. If you do not wish for your child to participate, please send an email to contact@inspirely.ca stating "I do not wish for my child to participate in the Inspirely Rewards Program."

Acknowledgment:

I agree and acknowledge that I have read and clearly understand all terms, conditions, policies, releases, consents, and liability waivers in the Inspirely Terms and Conditions, including the Field Trip Policy and Consent, and that I am voluntarily waiving certain legal rights, including limiting certain rights to bring claims against Inspirely and the Releasees for the matters contemplated herein.
